Der Beitrag bestimmt den logischen Standort und die Funktion des ursprünglich und a priori vereinigten Willens in Kants Rechtslehre. Der ursprünglich und a priori vereinigte Wille wird von einer ursprünglichen Gemeinschaft aller Menschen am Erdboden hervorgebracht, die ihrerseits auf einem ursprünglichen Recht eines jeden auf einen Platz auf dieser Erde gründet. Das ursprüngliche Recht auf einen Platz selbst folgt aus dem ursprünglichen Freiheitsrecht. Der ursprünglich vereinigte Wille richtet sich auf die Aufteilung des Erdbodens. Dadurch wird der ursprüngliche Erwerb von Sachen, (...) insbesondere von Grundstücken, möglich. Kant formuliert diese Möglichkeit in dem Postulat des § 2 der Rechtslehre, das ein Erlaubnisgesetz der praktischen Vernunft enthält: "Es ist möglich, einen jeden äußeren Gegenstand meiner Willkür als das Meine zu haben." Das Postulat folgt nicht analytisch aus dem ursprünglichen Freiheitsrecht. Es wird durch eine reductio ad absurdum der Annahme des Gegenteils begründet und enthält infolgedessen einen synthetischen Rechtssatz a priori. Zu dem Gebot, den Erdboden aufzuteilen, kommt das Postulat des öffentlichen Rechts , das den Eintritt in den -Staat gebietet, um das Eigentum an den Sachen zu sichern. Auch dieses Postulat hat den Charakter eines synthetischen Rechtssatzes a priori. Die Gründung eines -Staats setzt den ursprünglichen Kontrakt voraus. Das Eigentum an Grund und Boden geht jeder Staatsgründung voran, weil eine Staatsgründung nur möglich ist, wenn das Volk, das einen Staat gründen will, über ein mögliches Staatsgebiet verfügt.This article examines the logical location and function of the originally and a priori united will in Kant's Doctrine of Right. The originally and a priori united will flows out of the original community of all human beings on the earth's surface, which in turn is based on each person's original right to a place on this earth. The original right to a place on the earth's surface follows analytically from the original right to freedom. The originally united will commands us to divide the surface of the earth. This will to divide the land makes original acquisition possible. Kant formulates this possibility in § 2 of the Doctrine of Right, which contains a permissive law of practical reason: "It is possible to have any external object of my choice as mine." This postulate does not follow analytically from the original right to freedom. Instead it is based on a reductio ad absurdum and thus contains a synthetic principle of law a priori. The postulate of public law is added to the will to divide the earth's surface and requires entering a juridical state in order to secure property rights to things. This postulate is also a synthetic principle of law a priori. Founding a juridical state presupposes the original contract. Ownership of land logically precedes the founding of any state, because a state can be founded only if the people intending to found it have a state territory. (shrink)

In connection with his discussion of the three Ulpian formulae, Kant introduces three “leges,” namely the “lex iusti,” the “lex iuridica,” and the “lex iustitiae,” which he then defines in § 41 of the Doctrine of Right. The three “leges” correspond to the attributes “right,” “juridical,” and “established as right.” These three attributes in turn relate to the possibility, the reality, and the (material) necessity of our rights and juridical duties. The three “leges” and attributes have certain consequences for the (...) division of public justice, public justice being constitutive of the juridical state, into “iustitia tutatrix,” “iustitia commutativa,” and “iustitia distributiva.” This article provides a comprehensive account of all these concepts from § 41 of the Doctrine of Right. It also explains what until now has seemed to be a rather cryptic comment Kant makes at the end of his discussion of the Ulpian formulae regarding internal and external legal duties, and those legal duties that contain the derivation of the external legal duties from the principle of the internal legal duties through subsumption. Indeed the article provides the key to understanding the entire Doctrine of Right from a totally new perspective. (shrink)

Plato's Philebus contains an intricate difficulty. Plato seems to hold both (a) that all pleasures are processes of becoming, a crucial premise in the argument that no pleasure is good (53c?55c) and (b) that some pleasures contribute in their own right to the goodness of the best life (64c?67b). Since it seems also plausible that only things which are good can contribute to the goodness of the best life in their own right, Plato's view seems to be inconsistent. Interpreters usually (...) reject either (a) or (b). As Plato seems firmly committed to both (a) and (b), I propose a third way of dealing with the inconsistency. The apparent inconsistency highlights a vital contrast between what is independently good (good per se), what is dependently good (good through participating in what is independently good), and what is derivatively good (good through standing in a certain relation to dependent goods). I argue that while pleasure's being a process of becoming marks it out as derivatively good, some kinds of pleasure are also dependent goods in virtue of their objects ? irrespective of their being processes of becoming. In an attempt to discover new possibilities for advertising in uncluttered environments marketers have recently begun using ambient advertising in, for instance, bars and pubs. However, advertising in such licensed premises have to deal with the fact that many consumers are under the influence of alcohol while viewing the ad. This paper examines the effect of alcohol intoxication on attention to and memory for advertisements in two experiments. Study 1 used a forced exposure manipulation and revealed increased attention to logos (...) under alcohol intoxication consistent with the psychopharmacological prediction that alcohol intoxication narrows attention to the more salient features in the visual environment. Study 2 used a voluntary exposure manipulation in which ads were embedded in a magazine. The experiment revealed that alcohol intoxication reduces voluntary attention to ads and leads to a significant reduction in memory for the viewed ads. In popular terms consuming one or two beers reduces brand recall from 40 % to 36 % while being heavily intoxicated further reduces brand recall to 17 %. (shrink)

The growing interest and major advances of the last decades in evolutionary developmental biology (EvoDevo) have led to the recognition of the incompleteness of the Modern Synthesis of evolutionary theory. Here we discuss how paleontology makes significant contributions to integrate evolution and development. First, extinct organisms often inform us about developmental processes by showing a combination of features unrecorded in living species. We illustrate this point using the vertebrate fossil record and studies relating bone ossification to life history traits. Second, (...) we discuss exceptionally preserved fossils that document rare ontogenetic sequences and illustrate this case with the patterns of heterochrony observed in Cambrian crustacean larvae preserved three-dimensionally. Third, most fossils potentially document the evolutionary patterns of allometry and modularity, as well as some of the (paleo)ecological factors that had influenced them. The temporal persistence of adaptive patterns in rodent evolution serves to address the importance of ecological constraints in evolution. Fourth, we discuss how the macroevolutionary patterns observed in the tetrapod limb, in the mammal molar proportions, and in the molluscan shell provide independent tests of the validity of morphogenetic models proposed on living species. Reciprocally, these macroevolutionary patterns often act as a source of inspiration to investigate the underlying rules of development, because, at the end, they are the patterns that the neo-Darwinian theory was unable to account for. The so-called ‘Olympian’ proof in Plato's Republic contains one of the first explicit distinctions between the nature of intellectual and bodily pleasures. The argument for the superiority of the former rests on a) identifying pleasure and pain with certain kinds of filling and emptying, and b) differentiating between bodily and intellectual pleasures according to the kind of filling: Bodily depletions differ from depletions of the soul in the kind of lack and, accordingly, in the kind of thing that fills the (...) lack: hunger and thirst are bodily lacks which food and drink can cure, whereas ignorance and folly are cured by intelligence.Thus,, the kind of lack, together with the kind of filler, and derivatively the method of filling determine the kind of filling.Kinds of filling differ in truth: filling A is truer than filling B if and only if the kind of fillers used in A are more than the kind of fillers used in B and the kind of thing filled via A is more than the kind of thing filled via B.Fillers of the soul are more than bodily fillers.The soul is more than the body.Therefore,, filling of the soul is truer than bodily filling, that is, filling of the soul is more really a filling. Introduction Adolescents’ physical activity (PA) behavior can be driven by several psychosocial determinants at the same time. Most analyses use a variable-based approach that examines relations between PA-related determinants and PA behavior on the between-person level. Using this approach, possible coexistences of different psychosocial determinants within one person cannot be examined. Therefore, by applying a person-oriented approach, this study examined a) which profiles regarding PA-related psychosocial variables typically occur in female sixth-graders, b) if these profiles deliver a self-consistent picture according (...) to theoretical assumptions, and c) if the profiles contribute to the explanation of PA. Materials and Methods The sample comprised 475 female sixth-graders. Seventeen PA-related variables were assessed: support for autonomy, competence and relatedness in PE as well as their satisfaction in PE and leisure-time; behavioral regulation of exercise (five subscales); self-efficacy and social support from friends and family (two subscales). Moderate-to-vigorous PA was measured using accelerometers. Data were analyzed using the self-organizing maps (SOM) analysis, a cluster analysis including an unsupervised algorithm for non-linear models. Results According to the respective level of psychosocial resources, a positive, a medium and a negative cluster were identified. This superordinate cluster solution represented a self-consistent picture that was in line with theoretical assumptions. The three-cluster solution contributed to the explanation of PA behavior, with the positive cluster accumulating an average of six minutes more moderate-to-vigorous PA per day than the medium cluster and ten minutes more than the negative cluster. Additionally, SOM detected a subgroup within the positive cluster that benefited from a specific combination of intrinsic and external regulations with regard to PA. Discussion The results underline the relevance of the assessed psychosocial determinants of PA behavior in female sixth-graders. The results further indicate that the different psychosocial resources within a given person do not develop independently of one another, which supports the use of a person-oriented approach. In addition, the SOM analysis identified subgroups with specific characteristics, which would have remained undetected using variable-based approaches. Thus, this approach offers the possibility to reduce data complexity without overlooking subgroups with special demands that go beyond the superordinate cluster solution. (shrink)

This paper addresses the question, which sex ratio will evolve in a population that is subject to mutation and drift. The problem is analyzed using a simulation model as well as analytical methods. A detailed simulation model for the evolution of a population's allele distribution shows that for the sex ratio game a wide spectrum of different population states may evolve from on the one hand a monomorphic state with one predominant allele and with all other alleles suppressed by the (...) forces of selection, to on the other hand a polymorphism determined by recurrent mutations. Which of these states will evolve depends on the population size, the mating system and the rate of mutations. For the sex ratio game the evolutionarily stable strategy (ESS), as defined by evolutionary game theory, can only predict the population sex ratio but not the underlying stable population state. A comparison of different approaches to the problem shows that false predictions of the stable population states might result from two simplifying assumptions that are fairly common in evolutionary biology:a) it is assumed that mutations are rare events and there is never more than one mutant gene present in a population at any one time; b) a deterministic relationship is assumed between the fitness assigned to an individual's strategy and the individual's contribution to the gene pool of future generations. Der Kern der Logik, wie er sich in den Sätzen der Identität, des ausgeschlossenen Widerspruches und des ausgeschlossenen Dritten ausgedrückt findet, ist nicht revidierbar, auch nicht mit Hilfe von mehrwertigen Logiken. Überdies kommt der Logik, will man die uneingeschränkte Möglichkeit von Widersprüchen eliminieren, gegenüber der Dialektik der methodologische Primat zu. Der unaufhebbare Primat der Logik ist jedoch ein Primat und keine absolute Herrschaft, d.h. es ist möglich, die Grenze der Anwendbarkeit der Logik zu ermitteln. Diese Grenze ist dann erreicht, wenn (...) ein kontextvariantes Objekt nicht zu einem kontextinvarianten Objekt umgeformt werden kann. Das ist z. B. der Fall beim Ganzen im Sinne der Totalität. Dies Ergebnis hat Folgen für die Gültigkeit des Popperschen Falsifikationsprinzips: Läßt sich zeigen, daß die Widersprüche einer These nur von kontextvarianten Objekten, die sich nicht in kontextinvariante Objekte verwandeln lassen, herrühren, so ist die betreffende These aufgrund dieser Widersprüche allein noch nicht korrekturbedürftig, geschweige denn widerlegt. The degree of corroboration of a scientific hypothesis is an issue that has been repeatedly discussed in modern theory of sciences . In a preceding paper it was shown that the formulae advanced by Popper to calculate the degree of corroboration C are not very satisfactory because the probability values required in the computation of C are not available as a rule. Another equation to measure the degree of corroboration B was proposed ), whereby only the number n of unsuccessful (...) efforts to falsify a scientific hypothesis by means of adequate experiments or observations is needed to be known. Shortly after the publication of these ideas I discovered that Nicolaus Cusanus in his book "De docta ignorantia" had proposed a model of scientific "verisimilitude" which leads to a quite similar relationship between B and the number n of independent proofs or observations. The "polygonal" model of verisimilitude ) mentioned by Cusanus is presumably the first quantitative estimate proposed for this problem in philosophical literature. (shrink)

Empathy is a fundamental concept in health care and nursing. In academic literature, it has been primarily defined as a personal ability, act or experience. The relational dimensions of empathy have received far less attention. In our view, individualistic conceptualizations are restricted and do not adequately reflect the practice of empathy in daily care. We argue that a relational conceptualization of empathy contributes to a more realistic, nuanced and deeper understanding of the functions and limitations of empathy in professional care (...) practices. In this article, we explore the relational aspects of empathy, drawing on sources that offer a relational approach, such as the field of care ethics, the phenomenology of Edith Stein and qualitative research into interpersonal and interactive empathy. We analyse the relational aspects of three prevalent components of empathy definitions: the underlying ability or act (i.e. the cognitive, affective and perception abilities that enable empathy); the resulting experience (i.e. empathic understanding and affective responsivity) and the expression of this experience (i.e. empathic expression). Ultimately, we propose four inter‐related understandings of empathy: (a) A co‐creative practice based on the abilities and activities of both the empathizer and the empathee; (b) A fundamentally other‐oriented experience; (c) A dynamic, interactive process in which empathizer and empathee influence each other's experiences; (d) A quality of relationships. In a period of over 50 years, Peter Mittelstaedt has made substantial and lasting contributions to several fields in theoretical physics as well as the foundations and philosophy of physics. Here we present an overview of his achievements in physics and its foundations which may serve as a guide to the bibliography (printed in this Festschrift) of his publications. An appraisal of Peter Mittelstaedt’s work in the philosophy of physics is given in a separate contribution by B. Falkenburg.
